Rule of law
Allegations of breach of the rule of law must be related to a particular right and dealt with
contextually, and so cannot be treated in abstract by the Court. Accordingly, where
allegations of a breach of the rule of law are not related to a specific right, then the claim is
not substantiated the issue of breach of the rule of law was held not to have arisen where it is
not substantiated (Tanganyika Law Society, The Legal and Human Rights Centre v The
United Republic of Tanzania, application 009/2011; Reverend Christopher R. Mtikila v The
United Republic of Tanzania, application 011/2011, judgment, 14 June 2013, para 120).
