REPARATIONS Compensation for moral damage Moral damages is often assumed by international courts in cases of human rights violations (Konate, Reparations, para 58). Similarly in the Zongo reparations case, the Court held that the proof of moral damages may be assumed automatic consequence of human rights violations without the need to adduce any further proof (Zongo, Reparations, para 55). The Court will assess moral damages equitably taking into consideration the circumstance of each case (Zongo, Reparations, para 61).
