The Applicant had entered into an employment contract with the University as a lecturer in French to some junior students. He says he signed the contract of employment with the University on 1 December 1998 and started teaching on 5 July 1999, joining the French Department, which had its own head. The employment was for an indefinite period. One of the terms of the contract was that either party could terminate the contract on a three months' notice, or with a three months' payment in lieu of notice. The contract was with effect from 1 December 1998. As a result of certain complaints against him, the Applicant was dismissed from his post through a letter, written by the Registrar of the University, dated 2 December 1999. He took his case through Malawian Courts, including the Industrial Relations Court, right up to the Supreme Court of Appeal, the latter being the highest judicial authority in Malawi. The Applicant was still not satisfied; he therefore took the matter to the Commission.
