Compensation for material damage
It is not enough to show that the respondent state has committed wrongful acts, the applicant
must also lead evidence to show the damages and prejudices suffered (Lohe Issa Konate v
Burkina Faso, Reparations, Application No. 004/2013, 3 June 2016, para 46). The Court may
however, assess damages on the basis of equity (Konate, Reparations, para 43).
Reparations may also include the reimbursement of lawyers’ fees and other expenses incurred
in pursuing the ends of justice before national and international courts including transport to
and from court (Zongo, Reparations, paras 79 & 91).
