Right to be presumed innocent
The presumption of innocence as part of the right to fair trial requires that criminal sentences
be only imposed on the basis of strong and credible evidence (Mohamed, para 174). The
conviction of an accused person based on the testimony of one individual, which is riddled
with inconsistencies, does not meet the requirements of the right to fair trial (Mohamed, para
185).
